Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the Widget.vn platform, including the API, admin dashboard, and embedded widgets provided by Widget.vn. Widget.vn is operated by ERPFIT COMPANY LIMITED (CÔNG TY TNHH ERPFIT, “ERPFit”, “we”), tax code 0317567782. “You” means the business that registers an account. By using the service, you agree to these Terms.

2. Service Description

Widget.vn provides an embeddable widget platform for websites, including:

  • Data-protection compliance support widgets: Cookie Banner and Terms Consent, with consent-proof storage
  • Other embeddable UI widgets (maps, VietQR codes, job boards, reviews, etc.)
  • Admin dashboard for configuring and managing widgets
  • API for programmatic integration
  • CDN for widget code delivery

Our widgets help you meet your legal obligations; installing a widget does not by itself make your website compliant. You remain responsible for your notices, your purposes for collecting data, and how you use that data.

3. Accounts

3.1. Registration

You need to create an account to use the service. You are responsible for:

  • Providing accurate and up-to-date information
  • Keeping your login credentials and API keys secure
  • All activity that occurs under your account

3.2. API Keys

API keys are confidential. Do not share API keys publicly. If you suspect an API key has been compromised, generate a new one immediately through the dashboard.

4. Acceptable Use

You agree not to use Widget.vn to:

  • Distribute content that violates Vietnamese law
  • Send spam or fraudulent content through widgets
  • Attempt unauthorized access to systems or other users' data
  • Abuse the API (exceeding rate limits, DDoS attacks)
  • Embed widgets on websites with illegal content
  • Collect personal data without authorization through widgets

5. Pricing and Payment

5.1. Free Plan

The free plan has no time limit and includes Cookie Banner and Terms Consent, unlimited pageviews and consent-proof storage. No payment card required.

5.2. Pro Plan

Pro costs 2,640,000₫ for 12 months, paid once in advance by bank transfer via a VietQR code. Pro is activated once we confirm receipt of the transfer. It does not renew automatically; when it expires, your account returns to the free plan and your data is kept. Prices may change with 30 days notice and never apply to a period you have already paid for. Payments are non-refundable, except in cases of prolonged service disruption due to our fault.

5.3. Taxes

Listed prices include 10% VAT. The payment receipt in the admin dashboard is not a VAT invoice; VAT e-invoices are issued from ERPFit's accounting system as required by law.

5.4. Payments Through Widgets

Payment widgets (VietQR codes, payment buttons) only display your bank account or payment-gateway details. Transactions take place directly between your customer, you and your bank or payment provider. ERPFit never receives, holds or forwards funds on your behalf and is not a payment intermediary.

6. Data Processing Agreement

6.1. Roles

For personal data that visitors to your website submit through a widget (cookie choices, terms acceptances, contact forms, job applications, etc.), you are the controller and ERPFit is the processor under Vietnam's Personal Data Protection Law No. 91/2025/QH15. The data each widget stores is listed in section 3.2 of our Privacy Policy.

6.2. Your Responsibilities

  • Have a legal basis for collection, and inform visitors of the purposes of processing, including the use of Widget.vn as a processor
  • Configure widgets to collect only the data your purpose needs
  • Receive and answer data-subject requests; we help when you need it

6.3. Our Commitments

  • Process the data only to provide the service and according to your configuration and instructions; never for our own purposes, never sold, never used for another customer
  • Limit access to the staff who need it, under a duty of confidentiality
  • Apply the security measures in section 9 of the Privacy Policy, including per-customer data isolation
  • Use only the sub-processors listed in section 7 of the Privacy Policy, and notify you before adding or replacing one
  • Notify you without undue delay after discovering a breach that affects your data, and give you the information you need to notify the authority within the statutory deadline
  • Help you export, correct or delete one data subject's data on request
  • Provide the information you reasonably need to demonstrate compliance

6.4. Storage Location

Data is stored in Singapore as described in section 6 of the Privacy Policy. We will notify you before the storage location changes.

6.5. On Termination

When your account ends, we stop processing, provide a copy of the data on your request within 30 days, and then delete it. Backups are deleted on the retention cycle in section 8 of the Privacy Policy.

7. Intellectual Property

7.1. Platform

Widget.vn owns all rights to the platform, including widget source code, UI designs, APIs, and documentation. You are granted a non-exclusive, revocable license to use the service during your subscription.

7.2. Your Content

You retain full ownership of content you add to widgets (images, text, store data, etc.). You grant us the right to use this content solely to provide the service.

8. Service Availability

  • Free plan: No SLA commitment. Service is provided “as-is.”
  • Pro plan: We strive to maintain 99.5% uptime, but do not guarantee it absolutely.
  • We may suspend the service for maintenance with advance notice when possible.

9. Limitation of Liability

To the extent permitted by law:

  • Widget.vn is not liable for indirect, special, or consequential damages arising from use of the service
  • Our maximum liability does not exceed the total fees you have paid in the most recent 12 months
  • We are not responsible for content you display through widgets

10. Termination

10.1. By You

You may ask to close your account at any time by emailing [email protected]. Widgets stop working when the account is closed.

10.2. By Us

We may suspend or terminate your account if you violate these Terms, with 7 days email notice (except for serious violations requiring immediate action).

10.3. After Termination

After termination, you have 30 days to request a copy of your data. After this period, data is deleted as described in section 6.5 and our Privacy Policy.

11. Governing Law

These Terms are governed by Vietnamese law. Any disputes will be resolved at the competent courts in Vietnam.

12. Changes to Terms

We may update these Terms with 30 days notice via email. Continued use of the service after the notice period constitutes acceptance of the new terms.
